Decorative Botanical, Herb & Spice Purchases: Lebermuth does not have an ($) order minimum; a $20 processing fee will apply to all orders for product totaling less than $300. All orders requiring the repackaging of your decorative botanicals, herbs and/or spices will incur a handling & processing fee (these charges generally apply to UPS (United Parcel Service) and FEDEX (Federal Express) ground shipments. Applicable handling and processing fees will vary in direct proportion to the number of boxes and/or bags to be shipped. Fragrance, Flavor and Essential Oils Purchases: Minimum order of one (1) pound per oil.
BACK ORDERSBack-ordered decorative botanicals, herbs and spices will be considered canceled due to the length of time it can take to receive in merchandise. Please contact customer service for an expected date of availability. Back-ordered essential oils, flavors and fragrances will be shipped as expeditiously as possible. Please contact customer service if you do not want us to ship any backordered item(s). ADD-ONSOrders for all in-stock items received by 10:30 a.m. should ship within 72 hours. If you need to add to your original order, the item(s) added will be treated as separate orders even if placed the same day as the original order. Please place any add-on orders with the same representative who took your original order. This representative will then determine if the add-on can ship with the original order, or if you must again meet our minimum order policies. Additions received after 24 hours of your original order will be treated as a new order and will not ship together. EXPORTFor shipments outside North America we require a $500.00 minimum order. These requirements are necessary to cover the additional work incurred to complete customs documentation. QUANTITY PRICE BREAKS Our price breaks for decorative botanicals, herbs and spices are based upon purchases of original containers, 100-199 lb. and 200 lb. quantities. Price breaks listed for fragrance oils are provided in 1, 5, 10, 25, 50 and 100 lbs. or greater quantities. PURCHASES IN QUANTITIES GREATER THAN THOSE LISTED ARE NEGOTIATED AND BASED UPON CURRENT MARKET CONDITIONS PER ITEM. PLEASE CALL ONE OF OUR SALES PRICE CHANGESDue to unforeseen market fluctuations, prices listed are subject to change without notification. VERBAL ORDERS Verbal orders can cause shipping errors. In order to avoid these types of errors, we strongly urge you to place your orders in writing. For your convenience, we will provide you with an order form. Please ask a customer service representative for one allowing you to mail, fax or e-mail your order. Your written order will guarantee you will be shipped what you ordered. Of course, we will continue to accept verbal orders, if this is your preferred method of communicating. However, shipment errors resulting from orders taken verbally and not confirmed by you in writing will be at your expense (See RETURNS AND CREDITS). At your request, we will confirm your order in writing via fax or e-mail. Please be sure we have your current fax number or e-mail address on file. RETURNS AND CREDITSReturned merchandise is subject to a 20% re-stocking and handling fee. All claims for returns must be made within TEN (10) days of receipt of goods by calling customer service. No returns will be accepted after 30 days. At the time of your call, if your return is authorized, you will be provided with a Return Materials Authorization (RMA) number. Each piece you return must be clearly labeled with the correct Lebermuth facility address, which will be provided to you by customer service along with the RMA number. Failure to include this RMA number on the returning pieces will result in a delay of processing your credit. To receive full credit, all merchandise returned must be in good, saleable condition and in its original container. Every container should be sealed properly. Finally, full credit is subject to our evaluation and approval of the condition and quality of the returned merchandise. “DAMAGED” & “SHORTED” SHIPMENTSMerchandise that arrives to your facility damaged must be received and documented correctly. Failure to sign a bill of lading “damaged” and/or “shorted” for goods that shipped via a LTL (less than truckload) carrier such as Roadway or Yellow Freight, voids your right to claim compensation from the trucking company and Lebermuth. Processing a claim for merchandise shipped via UPS or FedEx requires us to conform to the shippers’ claims policy. Damaged merchandise must be kept in the original container with the product inside until a shipping representative has inspected the damages. Retain the shipping inspector’s documentation, and forward a copy of it to our customer service department. We will then begin processing a claim with UPS or FedEx. FREIGHTDecorative botanicals, accessories, herbs, and spices are sold F.O.B. Mishawaka, Indiana. HAZARDOUS SHIPPING INFORMATION FOR OILS Shipments of our products that have a flash point of 60.0 degrees Celsius (°C) but above 38.0 degrees Shipments of our products that have a flash point of 38.0 degrees Celsius (°C) or less are considered Certain products are considered hazardous via any mode of transportation by their own definition. Some international countries do not except hazardous material shipments. Any products designated as a hazardous material must be packed according to regulations and may incur higher shipping costs and longer shipping times. Since some hazardous classes can only be shipped using specific carriers and shipping modes Lebermuth reserves the right to choose the carrier & mode of transportation for hazardous shipments. Please contact Customer Service or your Account Executive for any questions relating to hazardous shipments. To find out the flash points of the products you are purchasing, please log onto our web site and print out a MSDS. Simply key in the item number and print out the MSDS for your files. Law requires you to have a MSDS on file for any products you buy and store in your facility. STORAGE OF OILSEssential oils and fragrances have a limited shelf life. Proper storage of these oils will ensure your inventory does not prematurely deteriorate. Oils should be stored in full, tightly sealed containers. Be sure your oils are stored away from direct light in a cool place (60 to 70 degrees Fahrenheit). For long-term storage of oils (more than 180 days) we recommend you nitrogen blanket the headspace of your containers to ensure preservation. Further information regarding the use and storage of oils can by found on the Certificate of Analysis and Material Safety Data Sheet documentation. DEA STATEMENTItems designated “DEA” are regulated materials. In order to purchase these materials, you must provide a copy of the DEA (Domestic Chemical Diversion Control Registration) Certificate along with the signature of your authorized buyer on our form “Authorized Buyers of DEA Regulated Products.” To obtain this form or to receive more information about buying regulated items, please call customer service. CREDIT TERMS/PAYMENT OPTIONS If you do not have an established line of credit with our company, you may pay for your merchandise by using Visa®, MasterCard®, Discover® or American Express®. You may request we establish a line of credit for your company. To establish a credit line, please complete and submit our credit application to our accounting department (customer service will be happy to mail, email, or fax you a copy). It will take approximately four weeks to process your application. A copy of your company’s General Resale Certificate and General Sales Tax Exemption Certificate from your state must be included with the credit application form. Returned checks are subject to a $30.00 fee. Prepays are not accepted. All merchandise ordered is payable in U.S. funds. FINANCE CHARGESA maximum finance charge of 2% per month (24% per annum) will be assessed to any past-due balance. SPECIAL SERVICESCustom Milling: Please call customer service for specific details. *Kosher: This product has been certified by Rabbi Yisreal Gettinger of the Indianapolis Board of Kashrus. A copy of the certification is available upon request. All products are sold on a wholesale basis; i.e. sold for further processing used to manufacture other products, or to be resold. LIMITATION OF PRODUCT LIABILITYLebermuth employs a number of quality control checks prior to shipping your order ensuring that errors are kept to a minimum. If a mistake is made, we will be monetarily liable for the error limited to the sales cost of the merchandise shipped and the freight charges (when sold f.o.b. from one of our facilities). Upon receipt of your merchandise, please check the goods carefully. Be certain the decorative botanicals, herbs and spices that you receive conform to what you have ordered. Fragrances, flavors and essential oils should be carefully reviewed. Double-check our item numbers with the original samples and paperwork you received. For those products that require manufacturing production batches, we strongly recommend you run a test batch using any new fragrance lot or essential oil lot before implementing a full production run. This will ensure that should there be any problems, they can be corrected without incurring a large loss. Our clients rarely experience problems with the raw materials we ship to them. However, we feel it is extremely important to emphasize that we are in a partnership with you. Both Lebermuth’s and your quality controls will help our companies succeed. We strongly recommend our clients print disclaimer and caution statements on their product labels that contain fragrances. An example of a caution/disclaimer would be:

DISCLAIMER FOR INFESTATIONHerbs, spices, and decorative botanicals are natural raw materials. As with corn and wheat, these natural goods can become infested with insects. Lebermuth implements several precautionary methods to control infestation. During warm months, our Mishawaka plant is fogged with Pyrethrum. Insect electrocute equipment is installed throughout our plant as well. We monitor our insect activity using Pheromone traps which trap and kill male Indian Meal Moths. Most importantly, every botanical we sell and is shipped from our plant is fumigated with either Methyl Bromide or Aluminum Phosphine. These fumigants have been scientifically proven to kill all stages of insects that typically infest botanicals. However, once botanicals are fumigated, they can again become re-infested as these EPA approved and legal fumigants do not remain on the botanicals (i.e. they leave no residue). If you observe infestation in botanicals, immediately isolate and remove the infested botanicals from your warehouse. This will limit the exposure of “clean” inventory and reduce any chance for cross-infestation by the infested botanicals. Insects can be exterminated by freezing the infested botanicals at zero degrees Fahrenheit. For alternative eradication methods, you may contact customer service to discuss actions to implement. Lebermuth makes no warranty that the botanicals we ship to you will be 100% free of infestation. We will work diligently with you to help you resolve infestation problems. We strongly recommend you implement a monitoring program for insect activity in your own storage areas. Please call customer service to discuss these methods. We will be happy to provide you with company names and phone numbers where you can purchase insect monitoring and eradication supplies.
SHIPMENT POLICY & NOTIFICATIONMost orders for in-stock items should ship within 72 business hours after receipt. Special ordered manufactured items such as fragrances and flavors will ship in approximately 5 business days (assuming all components are on-hand and have passed quality control). Shipment lead-time for products that require distillation will vary. Customer service can provide you with this information. During our busy season (June through November), orders may take longer to process. Orders that ship via UPS or FEDEX ground require your signature for delivery. If you would like to waive this requirement, please notify customer service. Orders weighing in excess of 300 pounds typically ship common carrier. If you do not have a discount program with a specified carrier, we will suggest one so that you will receive our discount. If your order will be shipping via UPS, FEDEX or common carrier, we can e-mail you an automatic shipment notification alerting you your order has shipped. The notification will include the carrier’s tracking, airway bill or pro number allowing you to track your order. Please be sure we have your current e-mail address on file by including it on your order or when speaking with one of our customer service representatives. CANCELLATIONSOrders completed and not shipped within 72 hours of placement are cancelable without incurring restock fees. Incomplete orders are cancelable without penalty. All shipped orders and customer pick-ups are subject to our Returns and Credits Policy. Non-stock items that are specially manufactured are non-returnable.
